24 seats of J&K Assembly vacant as they fall in PoK: Govt

NEW DELHI: Twenty-four seats of the Jammu and Kashmir Assembly are vacant as they fall under Pakistan-occupied Kashmir and will not be taken into account for reckoning the total strength of the House, Minister of State for Home G Kishan Reddy said today.

According to section 47 of the Constitution of Jammu and Kashmir, the Legislative Assembly comprises of 111 members chosen by direct election from territorial constituencies in the state, he said.

“However, as per section 48 of the Constitution of Jammu and Kashmir, until the area of the state under the occupation of Pakistan ceases to be so occupied and the people residing in that area elect their representatives, 24 seats in the Legislative Assembly shall remain vacant and shall not be taken into account for reckoning the total membership of the Assembly,” Reddy said in the Lok Sabha, replying to a written question.

The minister said Article 170 of the Constitution of India, which deals with delimitation of constituencies for state legislative assemblies, has not been extended to Jammu and Kashmir. “Delimitation of Legislative Assembly Constituencies in the State of Jammu and Kashmir is carried out under sections 47 and 141 of the Constitution of Jammu and Kashmir,” he said. The current strength of Jammu and Kashmir Assembly is 87.

Replying to another question the minister said that terror incidents in the hinterland have reduced by 70 per cent and in Jammu and Kashmir by 86 per cent in the last decade as compared to previous decade. Reddy also said the number of terrorist incidents has substantially reduced between April 1, 2009 and June 30, 2019 as compared to the previous decade.

“The number of terrorist incidents in the hinterland during the last decade as compared to the previous decade has reduced by 70 per cent from 71 to 21 and the number of terrorist incidents in Jammu and Kashmir has reduced by 86 per cent i.e. 23,290 to 3,187,” he said, replying to a written question. Further, the minister said, as compared to the corresponding period of 2018, the first half of this year has witnessed a reduction of 28 per cent in terrorists initiated incidents and an increase of 59 per cent in actions initiated by the security forces against terrorists in Jammu and Kashmir.
